Section 11:23-2.4 - Procedures for review of applications(a) The time period for the Department's review of an application shall commence the day the application is received.(b) The Department shall advise the applicant if the application is incomplete not later than 60 days after receipt of the application.(c) The application shall be deemed to be complete and approved if the applicant is not notified that the application is incomplete or disapproved within 60 days of the receipt of the application. If approval is deemed, the applicant shall notify the Department in writing of its intent to rely on a deemed approval prior to commencing operations.(d) Notice to the applicant that the application has been found to be incomplete shall specify the missing item(s) or information.(e) Any resubmission of the application after the deficiency has been cured shall be considered initial receipt.(f) The Department may disapprove an incomplete application.(g) Prior to approving an application, the Department may request that an applicant provide, in writing, any additional information that the Department deems necessary to consider the application. Failure by an applicant to provide the requested information to the Department within 45 days from the date of the Departments written request shall result in an application being deemed withdrawn without further notice.N.J.
