Section 10A:13-4.1 - Inmate job wages, work time credits and days worked
(a) Inmates shall receive wages and work time credits, if appropriate, for days worked or days credited as days worked in accordance with this section.
(b) Some inmates may be assigned to dual jobs each day, such as in the case of a dual job assignment that consists of attendance in an educational class or therapy group for one part of a work day and performing a job assignment during the other part of a work day. In these cases, the inmate may be paid varying wages for the work day, not to exceed the number of days in a month, and in accordance with the wage associated with the specific job.
(c) Inmate job assignments requiring coverage seven days per week may utilize more than one inmate working five days per week to allow for seven-day coverage.
(d) Certain correctional facility inmate jobs may warrant that an inmate be assigned seven days per week for operational effectiveness or in emergency situations. Such assignments shall be permitted and inmates shall be paid accordingly when verified and approved by the Administrator or designee. However, when a sufficient qualified and eligible workforce is available, inmates shall be assigned to work five days a week.
(e) Inmates shall not be permitted to earn overtime wages.
