Section 10:60C-1.2 - Scope and nature(a) The Personal Preference Program shall serve as an alternative delivery mechanism for eligible Medicaid/NJ FamilyCare PCA services.(b) Participants in the program shall be given both employer and budget authority to hire their own care providers within the scope of this chapter and compensate the care provider(s) using financial resources that would have been paid to a provider agency within the scope of the traditional PCA delivery model.(c) Participants in the program may utilize a portion of the benefit to purchase goods and services that are clearly related to meeting personal care needs. Approved purchase of goods and services are described at N.J.A.C. 10:60C-4.3(a), and items that are prohibited pursuant to the program are described at N.J.A.C. 10:60C-4.4(a).(d) Participants will be educated in how to develop and generate a back-up plan independently.(e) Participants shall be afforded an assessment and determination of needs that is similar in nature and value to that available under the traditional agency PCA model as described at N.J.A.C. 10:60-3.9.N.J.
