Section 10:110-7.3 - Annual fee

(a) Any IV-D case in which the State IV-D agency has collected at least $ 550.00 on behalf of an individual or a child receiving child support services, who has never received public assistance, shall be assessed an annual fee of $ 35.00.

(b) The State IV-D agency has the authority to:

1. Pay the fee using Federal incentive dollars as available; or

2. The State IV-D agency shall exercise its option under the Deficit Reduction Act of 2005 ( P.L. 109-171 ) and its implementing regulations to collect the fee from the non-custodial parent when Federal incentive dollars are not available.
