Section Site 102.17 - Critical wildlife habitat"Critical wildlife habitat" means, for a federally listed threatened or endangered species:
(a) The designated and mapped specific areas within the geographical area occupied by the species, at the time it is listed in accordance with the provisions of section 4 of the Endangered Species Act, 16 U.S.C. §1533, on which are found those physical or biological features: (1) Essential to the conservation of the species; and(2) Which can require special management considerations or protection; and(b) Specific areas outside the geographical area occupied by the species at the time it is listed in accordance with the provisions of section 4 of the Endangered Species Act, 16 U.S.C. § 1533, upon a determination by the Secretary of the United States Department of the Interior that such areas are essential for the conservation of the species.N.H.
