Section Saf-C 5205.01 - Appeal of Cost Recovery Bill
(a) Pursuant to RSA 154:8-a, II-a(e), the person responsible for the equipment contamination may appeal payment for such costs to the commissioner within 30 days of receipt of the bill for the costs.
(b) An appeal shall be sent in writing to:

(c) An appeal shall contain the following:
(1) The name and address of the person requesting an appeal;
(2) The name and address of the person's representative, if any;
(3) The name and address of the party seeking payment pursuant to RSA 154:8-a.
(4) A concise statement of the facts which warrant the relief requested;
(5) A description of the action which the person wishes the department to take;
(6) A citation to any statute, rules, orders or other authority which entitles the person to the relief requested;
(7) The date the person received the bill for the costs; and
(8) Signature of the person with a date indicating when the request for appeal was signed.
(d) Any request for an appeal shall also be provided to the party seeking payment at the same time and in the same method as filing with the commissioner.
(e) Within 30 days after receipt of the request for an appeal, the commissioner shall hold an administrative hearing.
(f) Pursuant to RSA 154:8-a, II-a(f), if no appeal is filed within 30 days after receipt of the bill, the person responsible for the hazardous materials response shall be deemed to have waived all right of appeal and shall be liable for payment to the municipality, organization, or mutual aid district for the total amount billed.
