Section Saf-C 411.02 - Scheduling of Hearings
(a) Upon receipt of a petition pursuant to RSA 270:74-a and these rules, the commissioner shall review said petition for compliance with these rules. If the commissioner determines that the petition is in compliance with these rules he or she shall, as soon as practicable, schedule a public hearing pursuant to RSA 270:74-a. If said petition is determined to be incomplete, he or she shall promptly return said petition to the first named petitioner, along with a statement as to the corrective action necessary to be in compliance with these rules.
(b) In scheduling a hearing pursuant to these rules, the commissioner shall give preference to those lakes, ponds or rivers set forth in 1989, 409:3.
(c) For the purpose of these rules, "preference", as it pertains to the scheduling of public hearings, means as follows:
(1) If 2 or more petitions are received by the bureau of hearings at the same time, the petitions shall be reviewed by the commissioner to determine if any petition pertains to a lake, pond or river set forth in 1989, 409:3; and
(2) If one of the petitions pertains to a lake, pond or river set forth in 1989, 409:3, it shall be scheduled for a public hearing before a petition for a lake, pond or river not set forth in 1989, 409:3, is considered.
(d) In scheduling a hearing pursuant to these rules, the commissioner shall, as far as is practicable, conduct said hearing in or near a town where the subject lake, pond or river is located.
(e) Any hearing scheduled pursuant to these rules shall, as far as is practicable, be conducted at a time that is convenient to members of the public.
