Section Saf-C 408.11 - Lights
(a) Mooring fields with 10 or more moorings shall have the corners or the perimeter of the mooring field designated by orange buoys with non-strobe flashing orange lights.
(b) Mooring fields with fewer than 10 moorings shall have the corners or perimeter lighted if the director or his designee determines that navigation or safety hazards exist at night.
(c) For the purposes of this rule, "navigation or safety hazard" shall include but not be limited to:
(1) Moorings situated in a customary path of boating traffic;
(2) A shallow and/or rocky area; and
(3) A public launch site near the mooring field.
(d) Additional orange buoys with non-strobe flashing orange lights shall be ordered by the director or his designee, if the location or size of the mooring field presents a threat to navigation or safety hazard at night.
(e) Pursuant to RSA 270:67, upon approval of a mooring field permit by governor and council, each applicant shall install the required lights prior to receiving any mooring decals.
(f) An applicant may submit a written request for a waiver of the lighting requirement along with the mooring field permit application. A waiver shall be granted if the director or his designee determines that the mooring field will not be a threat to navigation or safety hazard, if the mooring field is not equipped with lights.
