For the purposes of this part, a vehicle shall be deemed a special education vehicle if it is used to transport pupils whose individual education plan includes the need for special transportation. A mixed use school bus, as defined in Saf-C 1302.07, shall not be used to transport pupils with special needs to and from school or school related activities.
