Section Rko 213.01 - Commencement of Adjudicative Proceedings(a) An adjudicative proceeding shall be initiated at any time if: (1) The ombudsman concludes that to issue notice of such a proceeding would be beneficial to reaching a fair and expeditious resolution of the case;(2) The matter has reached a stage at which it is considered a contested case; and(3) The ombudsman issues an order of notice pursuant to Part Rko 210 above.(b) An adjudicative proceeding shall be initiated upon the request of a party or intervenor if: (1) A party or intervenor files a motion requesting such a proceeding; and(2) The ombudsman concludes that granting the motion would be beneficial to reaching a fair and expeditious resolution of the case.N.H.
