N.H. Admin. Code § Ret 302.01
Unclassified state employees, or state officials appointed for fixed terms, whose office or appointment has expired and are filling their offices on a holdover basis may request and shall receive a refund of accumulated contributions prior to actual termination of employment. If a member exercises the above provision and is subsequently reappointed to the same position, the member shall not be allowed to become a member of the system.
