Section Pos 1112.03 - Funds Level(a) The tuition guaranty trust fund shall maintain an operating level set by the director. Based upon the fees collected for this fund, current economic conditions, and the history of disbursements, the director shall adjust the operating level of this fund.(b) When the fund balance meets or exceeds the operating level, the director shall temporarily suspend collection of these fees for currently licensed schools that have made their required contributions to the fund. However, the suspension shall not apply to schools applying for their initial license. Once the operating balance drops below the operating level, the director shall reinstitute the collection of these fees.(c) The operating level for this fund shall not exceed 100% of the total annual gross tuition of all licensed schools.N.H.
