Section Pari 1104.04 - Revocation of a Lucky 7 License(a) Pursuant to RSA 287-E:25, the commission shall immediately revoke a lucky 7 license issued pursuant to this chapter if a licensee fails to comply with any requirement set forth in RSA 287-E:16 thru 26.(b) The commission shall revoke a charitable organization's license if the charitable organization fails to maintain a tax-exempt status or any other qualification of licensure.(c) The commission shall revoke a license if the licensee:(1) Is operating without a valid gaming license in any state or commonwealth in the United States;(2) Is found to be in violation of or has failed to meet any of the requirements of the statutes or regulations governing the operation, management, and conduct of charitable gaming in New Hampshire;(3) Willfully and knowingly conducts business with unauthorized entities;(4) Willfully and knowingly provides false information to the commission;(5) Knowing falsifies or makes any false entries in any books or records with respect to any transaction connected with the holding, operating, and conducting of any game of chance;(6) Fails to notify the commission within 15 days of the occurrence, knowledge of , or receipt of the filing of any administrative or legal action relating to charitable gaming, or the distribution of charitable gaming supplies involving or concerning the distributor, manufacturer, any officers, employees, agent or owner during the term of its license;(7) Fails or refuses to recall a product as directed by the commission;(8) Manipulates the outcome of any game, or otherwise compromises the integrity of the game;(9) Fails to comply with any commission order to submit records, bank statements, or any other paraphernalia associated with the operation and sale of lucky 7 tickets and lucky 7 ticket dispensing devices; or(10) Deliberately hinders or otherwise obstructs the effectiveness of an official inspection, investigation, or audit being conducted the commission.(d) In addition to (c) above, the commission shall revoke a charitable organization's license if the organization is not in good standing with its central organization, or the director of charitable trust, as applicable, when such action is deemed necessary by the commission to protect the public's interest in the property and assets committed to charitable purposes.(e) If the commission revokes a license issued pursuant to this chapter, the commission shall provide written notice to the charitable organization, distributor or manufacturer specifying:(1) The reason for revocation;(2) The effective date of the revocation; and(3) Information that an appeal of the denial may be requested, in accordance with RSA 541-A:30 and Jus 800, within 15 calendar days of the date on the notice of the denial.(f) Pursuant to RSA 287-E:25, a licensee whose license is revoked by the commission shall not be eligible for licensure for a period of up to one year from the date specified in (e)(2) above.N.H.
