Section Ins 3401.03 - Jurisdiction of the Commissioner; Penalties(a) The commissioner shall regulate the establishment and conduct of purchasing alliances.(b) No person or entity may market, sell, offer, or arrange for a package of one or more health benefit plans underwritten by a participating carrier or carriers to 2 or more small employers or their eligible employees without first being licensed by the commissioner pursuant to this part.(c) A person or entity not licensed by the commissioner as a purchasing alliance and engaged in the purchase, sale, marketing or distribution of health insurance or heath care benefit plans shall not hold itself out as an alliance, health insurance purchasing alliance, purchasing alliance, health insurance purchasing cooperative or purchasing cooperative or otherwise use a confusingly similar name.N.H.
