Section Hum 215.03 - Withdrawal of Complaints of Employment Discrimination on the Basis of Age Dually Filed with the Commission and the EEOC(a) A complainant withdrawing a complaint under RSA 354-A and the Age Discrimination in Employment Act, dually filed with the commission and the EEOC, shall complete a form calling for:(1) A written statement of the reason(s) for the withdrawal; and(2) The date and the signature of the complainant or the complainant's attorney in a space provided beneath a preprinted statement that the complainant wishes to withdraw his or her complaint filed with the commission; and(3) The date and the signature of the complainant or the complainant's attorney in a space provided beneath a preprinted statement that the complainant wishes to withdraw his or her complaint filed with the EEOC.(b) The effect of the signatures on the form shall be:(1) The complainant's acknowledgement that he or she is aware that the commission and the EEOC protect the right to file a complaint;(2) The complainant's averment that he or she has been advised that it is unlawful for any person covered by RSA 354-A or the Age Discrimination in Employment Act to retaliate against him or her for the filing of the complaint;(3) The complainant's averment that he or she has been advised that it is unlawful for any person covered by the enabling legislation of the commission to threaten, intimidate or harass him or her because of the filing of the complaint;(4) The complainant's assertion that he or she has not been forced to request the withdrawal; and(5) The complainant's statement that he or she wishes to withdraw the complaint filed with the commission and the complaint filed with the EEOC.N.H.
