Section He-Hea 204.03 - Ex-Parte Communication(a) Pursuant to RSA 151-C:8, XI, the board and its staff shall not communicate with any person or party concerning the merits of an application or petition before the board, except upon notice and opportunity for all parties to participate.(b) Prohibition against ex-parte communications shall not apply to: (1) Communications between board staff and the party in connection with completeness reviews.(2) Communication between board members;(3) Communication between the board and its staff and/or legal counsel or any consultant engaged by the board to assist it in evaluating an application; and(4) Distribution to the public of information required to be made available to the public by law.N.H.
