Section He-W 546.04 - Informing Requirements

The department shall carry out the informing requirements specified in 42 CFR 441.56 as follows:

(a) The department shall inform all pregnant women and children who are eligible for a medicaid program, or the parent(s) or legal representative(s) of eligible children, about EPSDT services within 60 days of the individual's initial eligibility determination for a medicaid program, and, in the case of families which have not utilized EPSDT services, annually thereafter, pursuant to 42 CFR 441.56(a) (4) ;
(b) The department shall complete the requirements set out in this section through written communications, oral communications, or any combination of both; and
(c) The department shall provide to recipients, or their parent(s) or legal representative(s), information about:
(1) The services available under the EPSDT program;
(2) The location of, and the requirements to obtain and use the health care or dental services available under the EPSDT program;
(3) The benefits of preventative health and dental care;
(4) The availability of medicaid payment for medical and dental services provided under the EPSDT program;
(5) The existence of other medical or social agencies available to assist a recipient, or to which a recipient may be referred, such as the department's bureau of maternal and child health services or bureau of special medical services;
(6) The availability of assistance in locating and accessing medical and dental services, upon request; and
(7) The availability of assistance with scheduling of medical or dental appointments and obtaining transportation, upon request.
