Except as provided in He-P 4035.71 the licensee shall require the authorized user of a diagnostic sealed source in a device specified in He-P 4035.39 to be a physician, dentist, or podiatrist who:
(a) Is certified by a specialty board whose certification process includes all the requirements in He-P 4035.68(c) and (d) and whose certification has been recognized by DHHS/RHS, an agreement state, or the Nuclear Regulatory Commission. The names of board certifications that have been recognized by the DHHS/RHS, an agreement state, or the Nuclear Regulatory Commission are posted on the NRC's Medical Uses Licensee Toolkit web page;(b) Is an authorized user for uses listed in He-P 4035.31, or the equivalent requirements of an agreement state or the Nuclear Regulatory Commission; or(c) Has completed 8 hours of classroom and laboratory training in basic radionuclide handling techniques specifically applicable to the use of the device, including training in: (1) Radiation physics, mathematics pertaining to the use and measurement of radioactivity, and instrumentation;(2) Radiation biology; and(3) Radiation protection.(d) Has completed training in the use of the device for the uses requested.N.H.
