Any Nuclear Regulatory Commission (NRC) and U.S. Department of Energy (DOE) prime contractor of the following categories operating in New Hampshire shall be exempt from He-P 4030 to the extent that such prime contractor under his prime contract manufactures, produces, receives, possesses, uses, transfers, owns, or acquires byproduct material:
(a) Prime contractors performing work for the Nuclear Regulatory Commission or DOE at U.S. Government-owned or controlled sites, including the transportation of byproduct material to or from such site and the performance of contract services during temporary interruptions of such transportation;(b) Prime contractors performing research in, or development, manufacture, storage, testing or transportation of, atomic weapons or components thereof; or(c) Prime contractors using or operating nuclear reactors or other nuclear devices in a U.S. Government-owned vehicle or vessel; and(d) Any other prime contractor or subcontractor manufactures, produces, transfers, receives, acquires, owns, possesses, or uses byproduct material under his prime contract or subcontract when DHHS/RHS and the Nuclear Regulatory Commission jointly determine that:(1) Under the terms of the contract or subcontract, there is adequate assurance that the work thereunder can be accomplished without undue risk to the public health and safety; and(2) The exemption of such contractor or subcontractor is otherwise authorized by law as stated in 10 CFR 30.12.(e) Common and contract carriers, freight forwarders, warehouse workers and the U.S. Postal Service are exempt from the regulations in He-P 4030 through He-P 4036, He-P 4038, and He-P 4039 to the extent that they transport or store byproduct material in the regular course of carriage for another or storage incident thereto.N.H.
