Section He-E 807.10 - Collection of CMPs(a) CMPs shall be collected pursuant to 42 CFR 488.442.(b) CMPs shall be deducted from the total medicaid billable per day for any single provider payment cycle.(c) CMPs shall be effective with the next provider payment cycle following: (1) Notification to the NF that the CMP is being imposed as described in He-E 807.09(b) ; or(2) If a hearing or appeal has been requested by the NF, the final administrative decision after a hearing or appeal.(d) CMPs collected from NFs or dually participating facilities, which means facilities certified under both medicare and medicaid, shall be returned to the Medicare Trust Fund and to the state CMP fund in accordance with 42 CFR 488.442(f) .(e) CMPs collected by the state medicaid agency shall be applied to the protection of the health or property of residents of the facilities that the state medicaid agency finds deficient as described in He-E 807.11(a) .N.H.
