Section Hcp 212.03 - Disposition of Petition(a) The board shall issue an order granting or denying a petition for rulemaking. If the petition is denied, the board shall state the reason therefore in the order.(b) The board shall deny a petition if:(1) The preponderance of the data or argument fails to support the petition;(2) It conflicts with an existing rule or statute, including RSA 137-F:1; or(3) The board determines it lacks the authority for the rule change.(c) If the petition is granted, the board shall undertake to commence a rulemaking proceeding in accordance with RSA 541-A:3.N.H. Admin. Code § Hcp 212.03
