Section Env-Wt 704.05 - Consideration of Public Input; Decision on Application(a) The department shall consider all comments received at the public hearing when determining whether to approve the application and issue a permit or to deny the application.(b) If the department determines that the criteria for issuing a permit have been met, the department shall proceed as specified in Env-Wt 705.(c) If the department determines that the criteria for issuing a permit have not been met, the department shall: (1) Deny the application; and(2) Notify the applicant in writing of the decision.(d) The written notification sent pursuant to (c)(2), above, shall specify the reason(s) for the denial.(e) If the applicant wishes to appeal the decision to deny the application, the applicant shall do so in accordance with RSA 21-O:14.N.H. Code Admin. R. Env-Wt 704.05
