Section Env-Ws 401.02 - Applicability(a)These rules shall apply to all discharges of pollutants from a point source to surface waters of the state that require only a state discharge permit.(b) These rules shall not apply to: (1) Facilities that require both a state discharge permit and a federal National Pollutant Discharge Elimination System (NPDES) permit under section 402 of the Clean Water Act, which are regulated pursuant to 40 CFR Part 122;(2) Those activities requiring water quality certifications pursuant to section 401 of the Clean Water Act, which are regulated pursuant to Env-Ws 451 through 455; or(3) Discharges to a POTW, which are regulated pursuant to Env-Ws 904.N.H. Code Admin. R. Env-Ws 401.02
