Section Env-Wr 302.03 - Repairs Required(a) Subject to (c), below, if the department determines as a result of an inspection that repairs or reconstruction to a dam are needed to maintain the dam in a safe condition, it shall notify the owner in writing of such repairs or reconstruction as are necessary and request the owner to undertake such repairs within the time period specified in the notice.(b) If the owner does not undertake the needed repairs or reconstruction within the time period indicated in a notice sent pursuant to (a), above, the department shall proceed under RSA 482:12 to order the owner to undertake the repairs or reconstruction.(c) The department shall not issue a request but instead shall directly issue an order requiring repairs or reconstruction if:(1) The condition of the dam poses an imminent threat to public safety; or(2) The owner of the dam has been non-responsive to department requests relating to other compliance issues.N.H.
