Section Env-Wq 403.38 - Extensions of Time(a) To request an extension of a deadline established pursuant to Env-Wq 403.14(b)(2) or (i)(3) or Env-Wq 403.21(c)(2), the applicant shall submit the following information in writing to the department: (1) Identification of the application to which the extension request relates by applicant name and municipality;(2) The length of the extension being requested; and(3) A full explanation of why an extension is necessary.(b) The department shall extend the deadline if:(1) The applicant demonstrates that good cause to extend the deadline exists; and(2) A complete request for deadline extension was submitted prior to the established deadline.(c) Good cause to extend a deadline shall be deemed to exist if: (1) In order to submit the missing component(s), the applicant requires information from a third party not under the applicant's control, and the applicant has not received the information despite making diligent efforts to obtain it; or(2) The applicant has otherwise been prevented by circumstances beyond the applicant's control from obtaining or preparing the missing component(s).(d) The inability to obtain requisite information from a third party based on the applicant's failure to pay the third party for services rendered shall not constitute good cause to extend a deadline.(e) The department shall issue a written decision on a request for an extension within 10 working days of receiving a complete request. If the extension is denied, the denial shall specifically set forth the reason(s) for the denial.(f) Denial of an extension shall not preclude an applicant from submitting a new application.N.H.
