Section Env-Wq 402.23 - Groundwater Discharge Zone(a) The boundary of the groundwater discharge zone shall be at or within the property or easement boundary or the mean high water mark of the closest surface water body, whichever is closest to the edge of the wastewater application area.(b) Except for subsurface disposal systems permitted under Env-Wq 402.08, use of groundwater within the groundwater discharge zone shall be controlled by the permittee, either by ownership of the overlying land or by deeded easement which grants the permittee the exclusive right to use the groundwater as a receiving medium for the wastewater disposal.N.H.
