Section Env-Wq 1907.03 - Waiver Criteria; Decisions(a) The department shall grant a waiver if the department finds that the alternatives proposed: (1) Are consistent with the purpose and intent of RSA 483:9-c;(2) Meet water quality standards; and(3) Would adequately protect public health, safety, and the environment.(b) The department shall not grant any waiver that contravenes the intent of any rule or conflicts with any statute.(c) The department shall issue a written response to a request for a waiver.(d) If the waiver is denied, the department shall specifically set forth the reason(s) for the denial.(e) Any person aggrieved by a waiver decision may appeal to the New Hampshire water council in accordance with RSA 21-O:14 and the rules adopted by the council, Env-WC 100-200.N.H.
