Section Env-Wq 1705.01 - Assimilative Capacity(a) Subject to (b), below, the department shall hold not less than 10 percent of the assimilative capacity of each surface water in reserve to provide for future needs.(b) For purposes of combined sewer overflows, the department shall determine compliance based on 99 percent of the assimilative capacity of the receiving surface water.N.H.
