Section Env-Wq 1205.18 - Waiver(a) No statement contained in the sewer use rules shall be construed as preventing any waiver pursuant to Env-Wq 305 between the WRBP and any user whereby the WRBP agrees to accept an industrial waste that otherwise would be prohibited by these rules for treatment, provided that such waivers meet the conditions set forth in (b), below.(b) A waiver shall be granted if it: (1) Does not violate any requirements of existing federal or state laws and/or regulations promulgated thereunder ;(2) Is compatible with any user charge system in effect;(3) Does not damage the POTW; and(4) Does not waive applicable national categorical pretreatment standards except as specified in 40 CFR 403.12(e)(2).N.H.
