Section Env-Wq 1203.09 - New or Modified Discharges to the POTW(a) Any person proposing a new discharge or an increase of more than 20 percent beyond limits previously permitted in the volume or character of pollutants that are being discharged to the POTW shall notify the community within the time limit established by the community ordinance prior to the proposed change or connection.(b) Any person proposing any of the following new discharges shall apply to the department for approval in accordance with Env-Wq 703.07: (1) Any extension of a collector or interceptor, whether public or private, regardless of flow;(2) Any wastewater connection or other discharge in excess of 5,000 gpd;(3) Any wastewater connection or other discharge to a WWTP operating in excess of 80 percent design flow capacity based on actual average flow for 3 consecutive months;(4) Any industrial wastewater connection or change in existing discharge of industrial wastewater, regardless of quality or quantity; and(5) Any sewage pumping station greater than 50 gpm or serving more than one building.(c) Any person discharging industrial wastes to the POTW shall comply with all applicable federal, state, and local pretreatment requirements, including the requirements of Env-Wq 1205 and in particular Env-Wq 1205.02(a) relative to significant industrial users.(d) No person shall discharge any commercial waste without first obtaining a commercial discharge permit from the WRBP in accordance with Env-Wq 1206.N.H.
