Section Env-Sw 1612.04 - Suspension(a) In any proceeding initiated pursuant to Env-Sw 1612.02, the department shall suspend the certificate, subject to (b) and (c), below, if the department determines that: (1) The underlying cause for the action cannot be corrected to conform to applicable requirements; and(2) The operator's conduct does not meet the criteria for revoking the certification specified in Env-Sw 1612.03(a).(b) If the department determines that the operator would benefit from additional continuing professional development, the department shall include as a condition of the suspension that the operator obtain the additional continuing professional development prior to requesting reinstatement pursuant to (c), below.(c) If a certificate is suspended pursuant to (a), above, the department shall not reinstate the certificate until: (1) The underlying cause for the action has been corrected to conform with applicable requirements;(2) Any conditions established under (b), above, have been met; and(3) The certificate holder submits a written request to the department requesting that the certificate be reinstated which includes such documentation as is necessary to demonstrate that any conditions established under (b), above, have been met.N.H.
