Section Env-Sw 1105.03 - Operating Approval(a) Except as provided in (e) below, upon receipt of a complete notice of intent to operate, a copy of the notice bearing the department's dated receipt stamp shall be returned to the permittee.(b) The permittee shall attach the returned copy of the notice to the permit.(c) The returned copy of the notice shall constitute approval to commence operations as specified in the notice and in accordance with the approved operating plan.(d) Approval to commence operations shall be subject to terms and conditions as necessary to assure that the facility operates in accordance with the approved plans and specifications, all applicable rules and regulations, and the terms and conditions of the permit.(e) If the permittee has not satisfied all prerequisites for operations, as specified in Env-Sw 1105.01, the notice of intent to construct shall not be returned by the department upon receipt and approval to commence operations shall be thereby withheld while permittee is notified and corrects the deficiency.(f) The department shall first notify the permittee by telephone of a deficiency pursuant to (e) above and follow it in writing within 10 working days if the permittee has not corrected the deficiency in the meantime.(g) Suspension or revocation of an operating approval shall be subject to Env-Sw 306.N.H.
