Section Env-Hw 807.03 - Off-Specification Used Oil(a) Used oil shall be classified as off-specification used oil if the oil: (1) Does not meet all of the standards in Table 8.1;(2) Has not been mixed with hazardous waste; and(3) Meets the standards in Table 8.2 below and does not otherwise exhibit any hazardous waste characteristics specified in Env-Hw 403: Table 8.2 Off-Specification Used Oil Standards

(b) Except as provided in Env-Hw 401.03(b)(26), used oil containing polychlorinated biphenyls (PCBs) at concentrations greater than or equal to 2 ppm shall be classified as off-specification used oil that is subject to all requirements for managing off-specification used oil in Env-Hw 807. Used oil containing PCBs also shall be subject to regulation under the Toxic Substances Control Act and its rules codified under 40 CFR Part 761.N.H. Code Admin. R. Env-Hw 807.03
