Section Env-Hw 703.04 - International Shipments(a) Notwithstanding any other provisions of the hazardous waste rules, a facility that imports or exports hazardous waste, except state-only waste, shall comply with 40 CFR 262 Subparts E and F, 40 CFR 264.71(a)(3), and 40 CFR 265.71(a)(3), as applicable, except as provided in (b), below.(b) A facility that exports or imports hazardous waste shall comply with 40 CFR 262 Subpart H if the hazardous waste is:(1) Exported to or imported from any of the countries listed in 40 CFR 262.58(a)(1) for purposes of recovery;(2) Not a state-only waste; and(3) Subject to: a. The manifesting requirements of Env-Hw 510;b. The universal waste management requirements of Env-Hw 1100; orc. The export requirements in the spent lead-acid battery management standards of 40 CFR 266, Subpart G.(c) Within 3 business days of receiving a shipment subject to 40 CFR 262, Subpart H, the owner or operator shall provide copies of the movement document to the parties specified in 40 CFR 264.71(d) and 40 CFR 265.71(d), as applicable.N.H.
