Section Env-Hw 304.23 - Permit Application Denial(a) If a permit application is denied, the following shall apply: (1) The department shall send written notice of denial to the applicant by registered mail, return receipt requested;(2) The notice of denial shall include a list of specific reasons for denial; and(3) The applicant whose permit application has been denied may appeal such denial to the waste management council in accordance with Env-WMC 200.(b) If a permit application is denied, the owner or operator may reapply to the department after making necessary modifications to the original permit application. The applicant shall submit the appropriate fee, as specified in Env-Hw 304.07(b) through (d), with any such reapplication.N.H. Code Admin. R. Env-Hw 304.23
