"Active portion" means that portion of a hazardous waste facility where treatment, storage, or disposal operations are being or have been conducted on or after November 19, 1980. The term does not include any portion of a hazardous waste facility that has been closed in accordance with a closure plan approved in accordance with Env-Hw 707.03 and Env-Hw 708.02 or predecessor rules in subtitle Env-Wm or He-P.
