Section Env-C 212.01 - Purpose and Applicability(a) The purpose of the rules in this part shall be to establish a mechanism whereby a person who is uncertain of the applicability of a particular statute implemented by the department or rule adopted by the department may request a decision in advance of taking an action that might be subject to such statute or rule.(b) These rules shall not be used to circumvent other established methods of adjudication, such as an appeal to a council created under RSA 21-O, in cases where the department has already made a determination, such as by issuing or denying a permit or by initiating an enforcement action.N.H.
