Section Env-C 204.12 - Record of the Proceeding(a) The record of an adjudicative proceeding for which the hearing is a record hearing shall comprise: (1) The notice(s) sent by the department pursuant to Env-C 204.06;(2) Any written response(s) to such notice(s);(3) All other correspondence between the department and a respondent or intervenor that relates to the proceeding;(4) All testimony, evidence, and arguments submitted by the participants;(5) All motions, objections or other responses to motions, and requests for findings of fact and rulings of law submitted by the participants;(6) Any information of which official notice was taken pursuant to Env-C 204.16(b); and(7) All rulings of the presiding officer.(b) The record of an adjudicative proceeding for which the hearing is an oral adjudicative hearing shall comprise: (1) All information specified in (a), above; and(2) A tape recording or other verbatim record of the oral hearing.(c) The record of an adjudicative proceeding shall be available for inspection by any person in accordance with Env-C 210.05.N.H.
