Section Env-AC 204.06 - Parties

(a) The parties to an appeal of an administrative order shall be:

(1) The person to whom the order was issued;

(2) The department; and

(3) Any person allowed by the council to intervene.

(b) The parties to an appeal of the denial of a permit application shall be:

(1) The person who filed the permit application;

(2) The department; and

(3) Any person allowed by the council to intervene.

(c) The parties to an appeal of the issuance of a permit shall be:

(1) The person who filed the appeal;

(2) The department;

(3) The permit holder, if not the appellant; and

(4) Any person allowed by the council to intervene.

(d) The parties to an appeal of a decision to grant a variance pursuant to RSA 125-C:16 shall be:

(1) The person who filed the appeal;

(2) The department;

(3) The person who received the variance, if not the appellant; and

(4) Any person allowed by the council to intervene.

(e) The parties to an appeal of a decision to deny a variance pursuant to RSA 125-C:16 shall be:

(1) The person who requested the variance;

(2) The department; and

(3) Any person allowed by the council to intervene.
