Section Env-AC 204.03 - Determination of Sufficiency of Notice of Appeal(a) Upon receipt of a document filed as a notice of appeal, the appeals clerk shall assign a docket number to the document and review the document for compliance with the requirements of Env-AC 204.01 and Env-AC 204.02(b).(b) If the document appears to comply with the requirements of Env-AC 204.01 and Env-AC 204.02(b), the appeals clerk shall distribute a copy of the notice of appeal to the council.(c) If the document was not filed within the applicable time limit as specified in Env-AC 204.01, the appeals clerk shall distribute a copy of the document to the council with a statement that the appeal was not timely filed.(d) If the document was timely filed but does not appear to comply with the requirements of Env-AC 204.02(b), the appeals clerk shall: (1) Send a written notice to the person who filed the document to inform the person that: a.The document does not meet the requirements of Env-AC 204.02(b); andb.If the person wishes to pursue the appeal, the person has 30 days in which to file a document that meets the requirements of Env-AC 204.02(b); and(2) Provide a copy of the written notice and the document to the council.(e) After the expiration of the 30-day period referred to in (d)(1)b., above, the appeals clerk shall: (1) Provide the council with a copy of any document received from the person; or(2) If no document was received, so inform the council at the first council meeting following the end of the 30-day period.N.H.
