Section Env-A 809.02 - Request Processing and Decision(a) Within 60 days of receipt of a request that meets the requirements of Env-A 809.01, the department shall review the request to determine whether it meets the criteria specified in (b), below.(b) The department shall approve the request if the department determines that the proposed alternate: (1) Achieves the purpose of the specified method or requirement; and(2) Produces results that are at least as precise and accurate as those produced by the specified method or requirement.(c) The department shall notify the person who submitted the request and EPA of the decision in writing. If the request is denied, the department shall specify the reason(s) for the denial.N.H. Code Admin. R. Env-A 809.02
