Section Env-A 619.02 - Applicability(a) This part shall apply to each new major stationary source or major modification for a source located in an area designated as attainment or unclassifiable under §107(d)(1)(B) of the Act for which the regulated NSR pollutant is subject to regulation.(b) This part shall not apply to a major stationary source or major modification with respect to a particular pollutant if the owner or operator demonstrates that, as to that pollutant, the source or modification is located in an area designated as nonattainment under §107 of the Act.N.H.
