Section Env-A 4704.06 - Prohibition Against Filing Duplicate Consistency Applications(a) Subject to (b), below, a consistency application shall not be submitted for an offset project if a consistency application has already been submitted for the same project, or any portion of the same project, in another participating state.(b) A consistency application may be submitted for an offset project after rejection by another participating state if the consistency application was rejected by the other participating state solely because more of the CO2 equivalent emissions reduction or carbon sequestration due to the offset project is projected to occur in New Hampshire than in any other participating state.(c) A consistency application shall not be submitted for CO2 credit retirement if a consistency application has already been submitted for the same CO2 credit retirement in another participating state.N.H.
