Section Env-A 4703.04 - Limitations on Award of Offset Allowances CO2 offset allowances shall not be awarded to:
(a) An offset project or CO2 credit retirement that is required pursuant to any local, state or federal law, regulation, or administrative or judicial order;(b) An offset project that includes an electric generation component, unless the project sponsor transfers legal rights to any and all attribute credits which may be used for compliance with a renewable portfolio standard or other regulatory requirement to the department, other than the CO2 offset allowances awarded under Env-A 4707 generated from the operation of the offset project;(c) An offset project that receives funding or other incentives from any system benefit fund, or funds or other incentives provided under RSA 125-O:23;(d) An offset project that is awarded credits or allowances under any other mandatory or voluntary greenhouse gas program, except as described in Env-A 4707.10; or(e) Equipment, materials, items, or actions unrelated to an offset project reduction of CO2 equivalent emissions or the sequestration of carbon, but occurring at a location where an offset project occurs, unless allowed under Env-A 4705 through Env-A 4709.N.H. Code Admin. R. Env-A 4703.04
