Section Env-A 3210.04 - Recertification Procedures for Sources Subject to the Acid Rain ProgramThe owner or operator of a NOx budget source that is subject to an acid rain program emissions limitation shall comply with the recertification procedures of 40 CFR 75, except that:
(a) If, prior to January 1, 1998, the administrator approved a petition under 40 CFR 75.17(a) or (b) for apportioning the NOx emission rate measured in a common stack or a petition under 40 CFR 75.66 for an alternative to a requirement in 40 CFR 75.17, the AAR shall resubmit the petition to the administrator to determine if the approval applies under this chapter; and(b) For any additional continuous emission monitoring systems ("CEMS") required under the common stack provisions in 40 CFR 75.72, or for any NOx concentration CEMS used under the provisions of 40 CFR 75.71(a)(2), the owner or operator shall meet the requirements of Env-A 3210.05.N.H. Code Admin. R. Env-A 3210.04
