Section Env-A 3110.01 - Compliance Burden(a) The DER user source shall be responsible for assuring that the generation and use of DERs comply with this rule.(b) The DER user source (not the enforcing authority) bears the burden of proving that DERs used are valid and sufficient and that the DER use meets all applicable requirements of this rule.(c) The DER user source shall be responsible for compliance with its underlying obligations.(d) In the event of enforcement against the user source for non-compliance, it shall not be a defense for the purpose of determining civil liability that the user source relied in good faith upon the generator source's representations.N.H.
