Section Env-A 2903.03 - Conversion of NOx Allowances to DERs(a) Allowances under this chapter shall not be considered offsets as defined in RSA 125-J:1, XX, however NOx allowances that are not used to satisfy the requirements of this chapter and that are not banked may be converted to non-ozone season NOx DERs in accordance with Env-A 3100.(b) Each affected source for which unused NOx allowances are converted to NOx DERs in accordance with Env-A 3103 shall surrender those converted allowances as if they had been used for actual emissions.
