Section Emp 501.14 - Failure to Report for Employment Services
(a) Employment services as referenced in Emp 501.11 and in this section shall include assessment, counseling, job clubs, job placement services, job search assistance, job search workshops, provision of occupational and labor market information, testing, referrals to employers, referrals to training and educational resources and programs, and similar services.
(b) Employment services shall be scheduled when claimants are initially claiming benefits or at any point during the claim filing process. If a claimant is deemed to require additional assistance, or has been selected to attend compulsory employment services, they shall be scheduled for one-on-one appointments when feasible for the department based upon available funding and other resources.
(c) Claimants shall attend scheduled employment services, including ongoing orientation meetings and workshops, and one-on-one appointments scheduled for those deemed to require additional assistance or for those who have been selected to attend compulsory employment services.
(d) A claimant who fails to report for one-on-one appointments scheduled for claimants deemed to require additional assistance, or who have been selected to attend compulsory employment services pursuant to Emp 501.11(a), or fails to provide all information requested pursuant to Emp 501.11(b) shall be deemed to not have reported as required by RSA 282-A:31, I(a) for the week in which such failure occurs, and for each week thereafter in which such failure continues unless the commissioner determines the individual had good cause for such failure.
(e) A claimant who fails to report for the second appointment of any orientation meeting or workshop, whether scheduled in group or individual sessions pursuant to Emp 501.11(a), or fails to provide all information requested pursuant to Emp 501.11(b) shall be deemed to not have reported as required by RSA 282-A:31, I(a) for the week in which such failure occurs, and for each week thereafter in which such failure continues unless the commissioner determines the individual had good cause for such failure.
(f) The commissioner shall find good cause based on the following circumstances:
(1) Illness, accident, death of a family member, or similar unanticipated event beyond the control of the claimant which conflicts with the scheduled employment services provided that the conflict is communicated to the department within 7 days of the date on which the failure occurred: or
(2) Being scheduled for work, a job interview, medical appointment, funeral, or similar anticipated event which conflicts with the scheduled employment services and which was communicated to the department prior to failure to report.
