Section Emp 205.02 - Disposition of Petitions For Declaratory Rulings(a) Within 45 days after a petition for declaratory ruling has been received in the office of the commissioner the commissioner or his authorized representative shall determine whether additional information or representations are needed from the petitioner and shall request the additional information or representations.(b) The commissioner or his authorized representative shall entertain briefs or conduct a hearing or both if he determines that additional information is necessary for him to render a decision.(c) Declaratory rulings shall be issued within 90 days of the date of the receipt of the petitioner's request or within 60 days of the receipt of needed additional information or representations, the receipt of briefs or of any hearing held, whichever is later.(d) A petition shall be dismissed if its subject matter is described at Emp 205.02(a)(5)a., b. or c. or if because of the nature of the subject matter or the failure of any petitioner to submit additional information, representations, requested briefs or to appear at any hearing, the department is unable to rule.N.H.
