Section Ed 1005.03 - Individual's Participation in the Assessment Process(a) The individual shall be offered every opportunity to actively participate in the assessment and decision-making process.(b) The individual shall: (1) Work with the NHVR counselor to understand how the assessment process is used to determine eligibility, plan for services, and identify an employment outcome;(2) Be available for assessment services and complete any agreed upon assessment activities within the timeframe established; and(3) Participate in a discussion of the results and what they mean in terms of achieving an employment outcome.(c) The individual shall have an opportunity to respond to assessment results and include a representative in any discussions.(d) While the decision-making process shall be collaborative, decisions shall reflect the judgment of the NHVR counselor in accordance with Ed 1000 and 34 CFR 361.N.H.
